This Privacy Statement also informs you about your rights and the possibilities to control your personal data and to protect your privacy.

1. PERSONAL DATA WE PROCESS WHEN WE PROVIDE THE WEBSITE

 

When we provide our Website to you, we process personal data for technical reasons every time you access the Website. These are data that we automatically process for every visitor when the Website is accessed.

2. NEWSLETTER & MAILING LIST

 

With your consent, we will send you our newsletter about the latest developments at Nudge Nudge Games to the email address provided.

Our e-mail newsletters are sent via the technical service provider The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (http://www.mailchimp.com/), to whom we pass on the data you provided when registering for the newsletter.

MailChimp uses this information to send and statistically evaluate the newsletter on our behalf. For evaluation purposes, the e-mails sent contain so-called web beacons or tracking pixels, which represent single-pixel image files stored on our website. This allows you to determine whether a newsletter message has been opened and which links have been clicked on. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). The data are raised exclusively in a pseudonymised manner and are not linked with your further personal data, a direct personal relationship is excluded. This data is for statistical analysis purposes only. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you wish to object to the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

Furthermore, MailChimp can use this data according to art. 6 Para. 1 f) GDPR even on the basis of its own legitimate interest in the demand-oriented design and optimization of the service as well as for market research purposes, for example to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to contact recipients directly or pass them on to third parties.

In order to protect your data in the USA, we have concluded a data processing order with MailChimp on the basis of the standard contractual clauses of the European Commission in order to enable the transmission of your personal data to MailChimp. 3. THE LEGAL BASIS FOR PROCESSING

 

When processing your personal data, we rely on the EU General Data Protection Regulation, an EU-wide legal framework for standardising data protection law (GDPR). If you contact us by e-mail or by telephone, the legal basis is your consent in accordance with Article 6 Para. 1 a) GDPR. We process the usage data for the purposes stated above on the basis of Article 6 Para. 1 f) GDPR to safeguard our legitimate interests. Newsletters are sent on the basis of Article 6 Para. 1 a) GDPR.

4. WITH WHOM WE SHARE YOUR INFORMATION

 

We will not transfer your data to others, with the exception of public authorities, in the event of legal obligations. For technical reasons our hosting provider and newsletter service provider are an exception to this rule. However, our hosting provider will process the usage data on our Website solely on our behalf and on our instructions and has undertaken to comply with strict requirements for the security of your data. The provider is Wix.com Ltd. with its seat of business in the USA and servers in Israel. Both Israel and USA are so-called “Third Countries”. You can, however, trust that Wix.com will process all data only as instructed by us and will provide an adequate level of protection for your data either by agreeing with us on the standard contractual clauses already mentioned above or by relying on a so-called adequacy decision made by the competent EU institutions.

5. RETENTION PERIOD

 

We delete your usage data as soon as it is no longer required for the provision of the Website. If you contact us, we will delete the data you have provided after the request has been processed, unless you give us your consent to store this data for a longer period of time.

6. USER PROFILES

We do not use your data to create a user profile. This means that we will not use your information to provide you with a personalised Website based on your personal preferences and interests or to provide you with customised offers based on your past behaviour.

You can assert the following rights against us within the scope of the GDPR with regard to your personal data:

However, this withdrawal will have future effect only. Any processing conducted prior to the withdrawal of your consent remains unaffected by this.
